Terms of Service

These Terms of Service ("Terms") govern your use of Stretchlings: Pet Puzzle (the "Game"), the website at testncode.hax.ee, and related services provided by TestNCode OÜ ("we", "us", or "our").

By downloading, accessing, or using the Game, you agree to these Terms. If you do not agree, do not use the Game.

The Game is intended for users aged 13 and above. Follow any higher minimum age or parental-consent requirements that apply in your country, and the age guidance in the Game's store listing.

If you are a parent or guardian and allow a child to use the Game, you agree to these Terms on the child's behalf to the extent permitted by applicable law, and you are responsible for supervising the child's use and authorizing purchases. You can use Google Play purchase authentication and parental controls to limit purchases. This does not limit rights relating to unauthorized purchases under applicable law.

3. License to Use the Game

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial entertainment purposes, subject to these Terms.

You may not:

• copy, sell, rent, sublicense, or commercially exploit the Game except where allowed by law;
• reverse engineer, decompile, or attempt to extract source code except where allowed by law;
• modify, tamper with, or manipulate the Game, its save files, in-game currency, or purchases;
• interfere with the operation, security, or integrity of the Game;
• use the Game for unlawful, abusive, or harmful purposes.

4. Custom Levels

The Game includes a level editor that lets you create custom levels ("Custom Levels"). Custom Levels are stored only on your device. The Game does not upload, publish, or share them, and we have no access to them.

Custom Levels are lost if you uninstall the Game or clear its data, unless your device backs them up. We are not responsible for lost Custom Levels.

5. Treats and In-Game Items

The Game contains an in-game currency called "Treats", earned by playing levels and minigames. Treats can be spent on the pets and other items offered for Treats in the Game. Treats cannot be purchased with real money. Separate items, such as pet skins and ad removal, may be offered for real money as described in Section 6. The shop shows whether an item costs Treats or real money before you obtain it.

Treats and in-game items:

• are for use within the Game and cannot be cashed out, transferred, or traded;
• give you permission to use the corresponding game content, rather than ownership of that content;
• are subject to the local-save and purchase-restoration limits described below.

Your earned Treats balance and items unlocked with Treats are saved on your device. Uninstalling the Game or clearing its data may erase them; Google Play purchase restoration does not restore earned Treats or items unlocked with Treats.

We may adjust how Treats are earned or what future unlocks cost as part of balancing the Game. Any changes affecting paid content remain subject to your mandatory consumer rights; the cash-out restriction does not prevent an applicable refund.

6. In-App Purchases

The Game offers optional in-app purchases, such as pet skins and the removal of advertisements, where available in your version and region. Purchases are processed by Google Play and are subject to the Google Play Terms of Service. The product, its price in real money, and what it unlocks are shown before you confirm a purchase. Treats purchases do not charge your payment method. Real-money purchases require authorization through Google Play. Pending, cancelled, or failed payments do not unlock paid content until Google Play confirms a completed purchase.

Permanent, non-consumable purchases, such as pet skins and ad removal, can be restored through the shop's "Restore Purchases" option using the same Google Play account, subject to store availability and confirmation of ownership. Restoration requires an internet connection. A local ownership record lets already-unlocked items work offline; it does not replace Google Play's purchase record.

A product described as consumable is used up when spent or used. If consumable items are offered, their quantity and use will be shown before purchase; spent consumables are not restored by "Restore Purchases". This does not limit remedies for a failed delivery, faulty content, or other rights under applicable consumer law.

For refunds, see Google Play's refund policies or contact us at testncodeou@gmail.com with your purchase issue. If a purchase is refunded or reversed, the corresponding paid entitlement may be removed. Do not send us payment-card details.

Your statutory rights relating to digital content, including remedies for content that is not supplied or does not conform to the contract, remain in force. Where an applicable withdrawal period exists, any loss of that right for immediately supplied digital content requires the consent and acknowledgment required by law during checkout; accepting these Terms alone does not waive that right.

7. Advertising

The Game shows advertisements provided by Google AdMob. While ads are active, some parts of the Game require an internet connection. You can remove ads with an in-app purchase. Ads may be personalized or non-personalized depending on your choices, location, and applicable requirements. Data use and consent choices are explained in our Privacy Policy.

Third-party advertisers are responsible for their own offers and destinations. An advertisement is not our endorsement of an offer, and you do not need to buy an advertised product to play. Nothing here limits responsibility or consumer rights that cannot lawfully be excluded.

8. Accounts

The Game does not require or offer user accounts. Your progress is saved on your device.

9. Availability and Changes

We may update, change, suspend, or discontinue any part of the Game or its features at any time, including levels, minigames, pets, or supported devices.

We do not guarantee that the Game or any feature will always be available, uninterrupted, or error-free. Changes to paid digital content and any discontinuation remain subject to applicable requirements for notice, updates, continued conformity, and remedies.

10. Intellectual Property

The Game, including its code, design, graphics, audio, branding, and other content provided by us, is owned by or licensed to TestNCode OÜ and is protected by applicable intellectual property laws. Except for the limited license granted in these Terms, no rights are transferred to you.

11. Third-Party Services

The Game relies on third-party services, including Google Play (distribution and purchases) and Google AdMob (advertising). Your use of third-party platforms is subject to their own applicable terms and policies. Our use of purchase and advertising data is explained in our Privacy Policy. This does not exclude our obligations under applicable law.

Optional PostHog gameplay analytics is planned but is not active as of the effective date. If introduced, it will be available only with your separate consent, using EU hosting, with session replay disabled and a 90-day limit for identifiable analytics as described in our Privacy Policy. You may decline or withdraw analytics consent without losing access to gameplay or purchases.

12. Privacy

Your use of the Game is also subject to our Privacy Policy, which explains how information is collected, used, and stored. Please read it carefully. Agreeing to these Terms does not give consent to personalized advertising, consent-required advertising identifiers, or optional PostHog analytics. These choices are requested separately before the relevant processing begins; advertising consent does not authorize analytics.

13. Disclaimer

The Game is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the Game will be uninterrupted, secure, or free from bugs or errors.

14. Limitation of Liability

To the maximum extent permitted by law, TestNCode OÜ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, in-game items, goodwill, profits, or business arising from or related to your use of the Game.

These exclusions do not apply to liability that cannot lawfully be excluded or limited, including applicable rights to refunds and remedies for paid digital content, or liability for fraud, intentional misconduct, or gross negligence where protected by applicable law.

15. Termination

These Terms apply for as long as you use the Game. You may stop using the Game at any time by uninstalling it. We may stop providing the Game or specific features at any time.

Sections relating to intellectual property, disclaimers, limitation of liability, and governing law will survive any termination.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide notice through the Game or website. Your continued use of the Game after updated Terms take effect means you accept the changes.

17. Governing Law

These Terms are governed by the laws of the Republic of Estonia and, where applicable, the laws of the European Union, unless otherwise required by mandatory consumer protection law in your country of residence.
